BREAKING: Democrat AG Won’t Prosecute in Aborted Baby Brain Harvesting Case

This afternoon, New Mexico Alliance for Life (NMAFL) held a press conference addressing a topic which is gaining national attention. The head of law enforcement in New Mexico, Attorney General Hector Balderas, is neglecting his most basic and essential duty of enforcing the law.

On May 24, 2012, five years ago today, the University of New Mexico (UNM) placed an order to late-term abortion provider Southwestern Women’s Options (SWO) for the brain of a third-trimester aborted baby to give to summer camp students to dissect. The Chancellor of the UNM Health Science Center, Dr. Paul Roth, even willingly admitted this illegal activity on camera.

Breaking two state laws, a SWO abortionist admitted that she never obtained consent from the mother of the aborted baby to make a fetal tissue donation. The Maternal Fetal and Infant Experimentation Act (MFIEA) requires consent for fetal tissue donation and the Jonathan Spradling Revised Uniform Anatomical Gift Act prohibits the donation of fetal tissue for research purposes.

Claims against those two acts only last five years, however, meaning that today is the day by which Balderas should have prosecuted UNM and SWO. However, Balderas has done nothing.

This is not even the first time that Balderas has allowed a criminal claim of these sorts to expire. Elisa Martinez, Director of NMAFL, rebuked Balderas for allowing “59 criminal claims to expire since receiving Congress’ 300-page criminal referral in June of last year.”

With a year of inaction from the Attorney General and the next claim of similar illegal activity set to expire in less than two weeks, on June 4, NMAFL is calling for a special prosecutor to investigate.

Using rhetoric most often employed by abortion advocates, Martinez told the press, “These women were not given a right to choose. Their right to choose was violated.”

Congressman Steve Pearce (R-N.M.) also offered a statement accusing Balderas of taking a “buffet style” approach to choosing which laws he wants to enforce.

Since Balderas does not seem to care about enforcing justice in his state, it is time for a new special prosecutor who will ensure that the laws of New Mexico and the rights of women in the state are upheld.
