Battle over Pronouns Presents Growing Threat to First Amendment

Earlier this month, a Virginia high school teacher was fired over his declining to use a transgender student’s preferred gender pronouns. Peter Vlaming had been a French teacher at West Point High School for the last seven years. However, when a female student of his returned to school after summer break as a transgender male, Vlaming told the student that, because of his Christian faith, he could not refer to the student using male pronouns. Hawaii Pro-Life Pregnancy Centers Secure Important Court Victory

The pro-life movement had a major victory last week in an unexpected state: Hawaii. A federal judge struck down a recently passed Hawaii law that required pregnancy centers to notify their clients of state-funded “comprehensive family planning services.” This meant that pro-life pregnancy centers were required to give notification of programs offering abortions. “Hawaii’s pro-life, nonprofit pregnancy centers offer free practical resources, information, and emotional support to women — no matter what choices those women make,” stated Derald Skinner. The Supreme Court Slaps Down Coerced Speech

The Supreme Court released two 5-to-4 decisions this week that have serious First Amendment implications. In both decisions, the Court ruled against government coercing speech. In NIFLA v. Becerra, the Supreme Court reversed the Ninth Circuit Court of Appeals decision that California’s Reproductive Freedom, Accountability, Comprehensive Care, and Transparency (FACT) Act was likely constitutional and remanded the case back to the Ninth Circuit for reconsideration. This law passed by the California Legislature and signed into law by Governor Jerry Brown in 2015 was enacted to regulate crisis pregnancy centers, in particular, pro-life centers that offer pregnancy-related services.
