Newly unsealed court documents reveal that the FBI was authorized to use deadly force against former President Donald Trump during its raid on Mar-a-Lago in August 2022. The documents show that Attorney General Merrick Garland personally approved the raid, which sought classified documents allegedly mishandled by Trump.
The raid has been described as unprecedented. Special Counsel Jack Smith subsequently indicted Trump for alleged mishandling of classified information. The unsealed operations order indicated that FBI agents were prepared to use deadly force if necessary and provided detailed instructions for engagement with Trump and his Secret Service detail.
“According to an ‘Operations Order’ produced in discovery, the FBI believed its objective for the Mar-a-Lago raid was to seize ‘classified information, NDI [national defense information], and US Government records as described in [the] search warrant,’” states a filing by Trump’s legal team.
“The Order contained a ‘Policy Statement’ regarding ‘Use Of Deadly Force,’ which stated, for example, ‘Law enforcement officers of the Department of Justice may use deadly force when necessary,’” the filing explains. “The agents planned to bring ‘Standard Issue Weapon[s],’ ‘Ammo,’ ‘Handcuffs,’ and ‘medium and large sized bolt cutters,’ but they were instructed to wear ‘unmarked polo or collared shirts’ and to keep ‘law enforcement equipment concealed.’”
Screenshots of the filing shared on social media indicate that the FBI had prepared for potential confrontations with Trump or his security team. A “Contingencies” list from the filing stated that agents should be ready to engage with Trump and the Secret Service if he was present at Mar-a-Lago.
Earlier this month, U.S. District Judge Aileen Cannon indefinitely postponed the trial in this case. The postponement followed admissions from the Department of Justice that some of the documents seized during the raid had been tampered with or misplaced.
