Representative Alexandria Ocasio-Cortez (D-NY) is threatening to impeach members of the Supreme Court after they ruled six to three that former President Donald J. Trump cannot be prosecuted for his official acts while in office. The far-left progressive congresswoman stated Monday in a post on X (formerly Twitter) that she intends to file articles of impeachment against the justices once Congress returns from the July 4 holiday.
“The Supreme Court has become consumed by a corruption crisis beyond its control,” Rep. Ocasio-Cortez wrote. She added: “Today’s ruling represents an assault on American democracy. It is up to Congress to defend our nation from this authoritarian capture. I intend on filing articles of impeachment upon our return.” It is unclear if Ocasio-Cortez intends to impeach the entire Supreme Court or just the six justices who ruled against Joe Biden‘s Department of Justice (DOJ) and its special counsel, Jack Smith, on the immunity claim.
Earlier on Monday, Chief Justice John Roberts wrote the opinion for the high court’s majority, stating: “The President therefore may not be prosecuted for exercising his core constitutional powers, and he is entitled, at a minimum, to a presumptive immunity from prosecution for all his official acts.” According to the justices, the burden of proof that former President Trump did not act in an official capacity when challenging the 2020 presidential election results rests on the Biden DOJ and Jack Smith.
Associate Justice Samuel Chase became the only member of the Supreme Court to have ever been impeached by the House of Representatives in 1804. However, the Senate acquitted Chase of the charges just a year later.
