The Democrat judge who released six migrant squatters arrested on drug and weapons charges last week previously released two men who assaulted a police officer.
Bronx Criminal Court Judge Eugene Bowen, elected as a Democrat in 2022, went against the wishes of the prosecutors by setting free six suspected migrant squatters who were apprehended on drug and weapon charges. Among the migrants was Hector Desousa-Villalta, a 24-year-old Venezuelan man, who was earlier arrested on attempted murder charges before his case collapsed. Despite requests from the prosecutors to hold Desousa-Villalta on $150,000 cash bail, Bowen decided to let him and five others free with no imposed bail.
Previously, Judge Bowen sparked controversy by releasing two men who had assaulted a police officer. The offenders, Kaream McClary, 23, and Izayiah Jessamy, 20, physically assaulted Officer John Hernandez at the Freeman Street subway station after the officer requested them to put out their cigarettes. Despite the bail plea made by the prosecution team, the duo was released without bail.
Before his election, Bowen was a criminal defense attorney for the Legal Aid Society.
Former Assistant U.S. Attorney Andrew McCarthy claimed that Bowen’s sympathetic stance towards alleged criminals aligns with the city’s judicial election pattern, which is often marked by low turnout and dominated by progressive Democrats.
“Progressive Democrats in New York City are the principal drivers of sanctuary city and criminal justice ‘reform’ policies,” McCarthy said. “Under the former, the city prohibits NYPD from cooperating with the feds in immigration case. Under the latter, serious criminals are routinely released instantly after arrest — New York is the only state in the country that does not permit judges to detain people pretrial on evidence that they pose a danger to the community.”
