🎯IMPACT: The decision keeps Medicaid public funds flowing to Planned Parenthood, sparking criticism from pro-life advocates.
A federal judge appointed by former Democrat President Barack Obama has blocked the Trump administration from withholding Medicaid funding from Planned Parenthood. U.S. District Judge Indira Talwani determined that the Department of Health and Human Services did not give adequate notice, as required by the Spending Clause of the U.S. Constitution, to several Democratic-led states.
The decision halts a Republican-supported measure in the One Big, Beautiful Bill Act that would have temporarily stripped Medicaid dollars from organizations that perform or promote abortions for one year. Talwani ruled in favor of California and other blue states that challenged the cut.
Pro-life leaders condemned the ruling. Marjorie Dannenfelser, president of SBA Pro-Life America, said: “The Democrats and their radical activist judges are desperately seeking to thwart the will of the people and bail out the Big Abortion industry, led by Planned Parenthood. The One Big Beautiful Bill Act is federal law passed by Congress and signed by the President.” She continued: “This fight is not over. The pro-life movement will work tirelessly to ensure the Democrats do not prevail and taxpayers are never forced to pay a dime to prop up Big Abortion businesses.”
Judge Talwani, who has a history of supporting abortionists and Democratic causes, has contributed $1,725 to Democratic candidates and party organizations, including former John Kerry, Elizabeth Warren, and former President Obama. She also volunteered on Obama’s 2008 presidential campaign and Warren’s 2012 Senate campaign.
Talwani has issued prior rulings against Trump policies, among them decisions involving Temporary Protected Status (TPS) for migrants and a 2019 order related to U.S. Immigration and Customs Enforcement (ICE) arrests at Massachusetts courthouses.
