DOJ Files Motion to Hide Jan 6 Docs in Trump Case Discovery.

The Department of Justice (DOJ)’s special counsel in the January 6 case, Jack Smith, has filed a motion rejecting Donald Trump’s request for documents from multiple government agencies.

Smith argued this weekend that Trump’s demands amount to “an unprecedented expansion of the Government’s discovery obligations that would provide special treatment for him and result in delay.”

Smith claims the “prosecution team” is not the entire executive branch, meaning documents belonging to the Federal Bureau of Investigations, the U.S. Attorney’s Office, the DOJ, the Special Counsel’s office, the Department of Defense, the Department of Homeland Security, and other Congressional committees, are “not discoverable”.

“The Government has taken a broad approach to discovery, providing voluminous, comprehensive, and early productions that exceed its obligations,” Smith adds.

The motion accepts prosecutors must reveal information that may be useful to a defendant, yet claims much information Trump has requested “is not in the Government’s possession, [and] in many cases does not appear to exist…”

Reports suggest the information is not discoverable because thousands of texts between Secret Service officials were deleted in January 2021 “after House Democrats notified executive agencies to preserve all Jan 6-related records.” Other withheld information includes Secret Service transcripts, which detail operations on January 6, 2021.

A damning report by the U.S. Coast Guard has revealed that a “toxic workplace culture” and negligence at OceanGate contributed to the implosion of the Titan submersible on June 18, 2023. The tragedy claimed the lives of five individuals during a mission to explore the wreck of the Titanic.

The victims included Stockton Rush, the founder of OceanGate and operator of the Titan, along with Pakistani businessman Shahzada Dawood and his teenage son Suleman, British adventurer Hamish Harding, and Titanic expert Paul-Henri Nargeolet. The submersible’s wreckage was discovered five days after it went missing, approximately 500 meters from the Titanic.

The 335-page report from the Marine Board of Investigation (MBI) concluded that “the loss of five lives was preventable” and identified eight primary causal factors behind the incident. These included OceanGate’s flawed design and testing processes, a lack of proper inspections, and the continued use of the Titan despite prior incidents compromising its structural integrity.

In addition, the report also highlighted OceanGate’s “toxic workplace culture,” insufficient regulatory frameworks for novel submersible designs, and an ineffective whistleblower process. Investigators noted that Stockton Rush “exhibited negligence that contributed to the deaths of four individuals” and may have been subject to potential criminal liability. The National Pulse previously reported that Rush prioritized diversity over experience when putting together crews. “When I started business… other sub operators [were] out there but they typically [had] gentlemen who are ex-military submariners… a whole bunch of 50-year-old white guys,” he said during a 2020 interview.

Lead investigator Thomas Whalen and marine board chairman Jason Neubauer wrote, “By strategically creating and exploiting regulatory confusion and oversight challenges, OceanGate was ultimately able to operate Titan completely outside of the established deep-sea protocols.” The absence of third-party oversight and experienced staff during the 2023 operations was cited as a critical factor leading to the catastrophic event.

A panel of three judges unanimously overturned a lower court’s ruling, determining that the provision does not infringe upon the Civil Rights Act of 1964, since it is relevant to verifying voter eligibility.
In the unanimous decision penned by Judge James Ho, he declared, “Mail-in ballots are not secure,” citing insights from Veasey v. Perry, which evolved into Veasey v. Abbott. The litigation emphasized that “mail-in ballot fraud is a significant threat,” an issue previously affirmed by the Fifth Circuit in earlier decisions.

Ho elaborated in the opinion that the ID number mandate is “obviously designed to confirm that each mail-in ballot voter is precisely who he claims he is.” He further noted that this stipulation is clearly pertinent to assessing voter eligibility according to state regulations. The court also followed the Third Circuit’s established ruling, which holds that materiality clauses are limited to evaluations of voter qualifications.

Although the plaintiffs contended that there was a lack of substantial proof demonstrating that the ID number rule would substantially curb voter fraud, Texas countered this view. “Our precedents compel us to side with Texas. We have made clear that states have a legitimate interest in combating voter fraud, and thus enjoy ‘considerable discretion in deciding what is an adequate level of effectiveness to serve [their] important interests in voter integrity,’” Ho stated.

Governor Gavin Newsom (D-CA) has indicated he’s prepared to move forward with the partisan redistricting effort, including calling a statewide vote on the matter. “California will not sit by idly and watch this democracy waste away,” Newsom said on August 4, underscoring his frustration with redistricting moves in other states, particularly Texas. He added that a special election could be scheduled for early November to allow voters to weigh in. Still, he emphasized he would reconsider if Texas Republicans paused their redistricting campaign.

This effort comes as a direct response to Texas Republicans’ push to reshape their state’s congressional map, which some claim is being done in favor of the GOP ahead of the 2026 elections. Democrat lawmakers tried to disrupt the process by fleeing the state to avoid voting on the redistricting plans. In response, Texas Governor Greg Abbott ordered the arrest and return of any member caught abandoning their duties.

California’s proposal aims to counterbalance those moves by strengthening Democratic margins in politically mixed regions such as Orange County, San Diego County, and parts of the Central Valley.

Bill Maher issued a warning to the Democratic Party during the latest episode of Real Time, urging its leadership to break away from far-left ideologies and figures like New York City mayoral candidate Zohran Mamdani. Maher described the party as grappling with an “identity crisis” and questioned its alignment with Western values versus extremist ideologies.

“The world is a complicated place and it’s not just about oppressor and oppressed,” Maher said. He criticized certain Democrats for viewing history through a narrow lens, adding, “Until they do, I don’t think the Democratic Party is going to go forward until they make a decision: whose side are you on here? Are you on the side of Western civilization and Western values or are you on the side of the terrorists?”

Maher singled out Mamdani as emblematic of the extremism infiltrating the party. “Some of the things he says, you know he quotes Marxists, ‘each according to their need.’ I mean, that’s straight-up communism,” Maher said. His remarks came after a heated exchange with Rep. Jason Crow (D-CO), who dismissed the criticisms as attempts to create a “boogeyman.” Maher fired back, “No, these are quotes. I’m not creating anything, I’m quoting [Mamdani].”

Author James Kirchick, also a guest on the program, expanded on Maher’s concerns, stating that Mamdani represented everything the far-right once accused Barack Obama of being. “Everything that the crazy far-right alleged about Obama, wasn’t born in America, Islamist, socialist, antisemite, hates America, it’s all true about this guy [Mamdani],” Kirchick said. He further criticized Mamdani’s support for the phrase “globalize the intifada,” which Kirchick argued explicitly calls for violence against Jews.

Mamdani has since stated he would stop using the phrase and “discourage” others from doing so, but tensions persist. A July poll by American Pulse revealed that 30 percent of New York City voters support Mamdani’s refusal to condemn the slogan and his backing of the anti-Israel boycott movement, underscoring divisions within the Democratic Party.
