A petition demanding that Supreme Court Justices Samuel Alito and Clarence Thomas recuse themselves from cases related to the January 6, 2021, riots at the U.S. Capitol has garnered 50,000 signatures. Far-left progressive activist group MoveOn initiated the petition after The New York Times reported Justice Alito displayed an upside-down American flag shortly before Joe Biden‘s inauguration as President.
According to Alito, his wife placed the flag upside down following a dispute with neighbors. The Supreme Court Justice has dismissed calls for his resignation from the high court and his recusal on cases relating to the Capitol riots or former President Donald J. Trump.
The New York Times story and MoveOn petition appear to be part of a larger left-wing public pressure campaign to force the recusal of several conservative Supreme Court Justices from two upcoming decisions. Both Fisher v. United States and Trump’s presidential immunity appeal could significantly impact the Biden government’s lawfare campaign against the incumbent Democrat’s 2024 presidential election opponent.
MoveOn contends that Alito’s association with the flag incident and Justice Thomas‘s wife Ginni’s communications regarding the Trump team’s efforts to expose voter fraud in 2020 undermine the court’s integrity. The petition also calls on Chief Justice John Roberts to take action if the Justices do not voluntarily recuse themselves.
Senator Dick Durbin (D-IL) has echoed the arguments made by MoveOn and urged for Alito’s recusal. Additionally, the Illinois Democrat is calling for a binding code of ethics for the court.
